Privacy Policy

INTRODUCTION

This document on privacy protection ("Privacy Policy") of the website ("Site") is published by Flora Ventures S.L., under the registered trademark Days of Confidence, registered with the Madrid Chamber of Commerce before Notary D. Pedro Antonio Mateos Salgado, on 8 April 2019, protocol number 2924 with VAT number ES88362926, with registered office at Calle Hiedra, 74, Alcobendas (Madrid), 28109, Spain.

The privacy policy presented on the Days of Confidence ("DoC") website complies with the requirements of the GDPR.


I. PROCESSING OF USERS' PERSONAL DATA

Conditions for the processing of users' personal data.

When creating an account, users must validate the privacy policy, by which they agree to be bound. The Privacy Policy may be amended or updated at any time without prior notice, except for those provisions requiring Users' consent. Capitalised terms are those defined in the T&Cs.

DoC collects and uses the Personal Data that Users have spontaneously provided, which is necessary for placing an Order, receiving DoC's informational emails (newsletters), or for communication via WhatsApp.

Your personal data is processed by DoC as data controller, in order to respond to your information request or for marketing communications via WhatsApp.

Your data will be retained for up to five (5) years after your last Order, during which period you may freely access your data, rectify it, request its deletion, object to its processing, and obtain it in a structured and readable format (unless there is a legitimate impediment).

In accordance with applicable data protection legislation and regulations, you may exercise your rights by contacting DoC, Simplified Joint Stock Company, Calle de la Hiedra 74, Alcobendas, Madrid, 28109, Spain. You also have the right to lodge a complaint with a supervisory authority and to set out guidelines for your digital estate.

Users are required to provide their personal data and information accurately, truthfully and precisely, and to update such data and information as soon as necessary to keep it accurate and complete.

DoC collects and processes Users' Personal Data fairly and lawfully and in respect of their rights. DoC is responsible for the processing of users' personal data.

The purposes for processing Customers' Personal Data are:
- the commercial management of DoC product orders placed through the website daysofconfidence.co,
- Sending informational emails about DoC news,
- carrying out prospecting activities,

- marketing communications via WhatsApp for Users who have given their explicit consent,
- Analysis of website audience at daysofconfidence.co or commercial statistics,
- the organisation of competitions, lotteries or any promotional activity,
- management of non-payment and disputes,
- management of notifications.

 

Sending marketing communications via WhatsApp

DoC may use the telephone numbers collected to send information or promotions to Customers via WhatsApp. Users must give their explicit consent to receive these communications. They may unsubscribe at any time by simply replying with the word "STOP" to one of the messages

Under no circumstances will DoC transfer or sell Users' Personal Data to third parties, except in the cases mentioned below. 

Nature of personal data collected by DoC

The Personal Data that may be processed is as follows: first and last name, postal address, email address, Customers' telephone number and Users' IP address.

Protection, storage and deletion of personal data

Personal Data provided by Users is hosted by DoC's hosting providers.

At any time, Customers may request the closure of their Account, which will result in the deletion of the associated Personal Data.

Account deletion will be effective within two (2) months of the deletion request and, in any case, after any ongoing Order. 

DoC retains Customers' Personal Data for the duration of their Account and deletes it within a maximum of five (5) years after its closure. Telephone numbers collected via WhatsApp will also be retained during this period and may be deleted upon request by sending a "STOP" message via WhatsApp.

DoC communications

DoC may send Customers who have consented emails to the address associated with their Account to inform them of developments on the Site or its activities, or to communicate technical or administrative information.
Customers who have agreed to receive communications via WhatsApp may unsubscribe at any time by replying with the word "STOP" to one of the messages received.
Under no circumstances will Customers receive emails from third-party companies or DoC partners without their authorisation.

Transfer of users' personal data

DoC may transfer Users' Personal Data to its service providers, such as Shopify, Klaviyo, Google Analytics, Facebook, Instagram, Pinterest, LinkedIn, TikTok.
DoC may also share information collected via WhatsApp with its providers if necessary for the proper functioning of the communication service on this platform.
DoC undertakes not to communicate, transfer or pass on Personal Data to other third parties (except providers) without Customers' express consent, but may communicate it if required by law or by judicial or administrative order.

Users' rights over their personal data

In accordance with applicable data protection legislation and regulations, DoC informs Users of their right of access, rectification, objection to processing and request for deletion of their Personal Data collected and processed, noting that the deletion of their data will entail the closure of their Account and the right to obtain it in a structured and readable format (unless there is a legitimate impediment). For data collected via WhatsApp, users may also request deletion by sending a "STOP" message or by contacting DoC directly. They also have the right to lodge a complaint with a supervisory authority and to define guidelines relating to their Digital Will.

II. COOKIE POLICY USED BY DOC

Cookies

A cookie is a file that can be saved to the hard drive of Customers' and Users' devices when they browse the Site. These small files may contain, for example, the shopping basket and the Customer's preferences.

DoC may deposit cookies on Users' devices to enable them to browse the Site in optimal conditions, to save Customers' profiles and restore their preferences when they connect via their usual device, to determine Products viewed or purchased, or to produce statistics. 

Types of cookies used through the Site

DoC uses cookies:

. navigation cookies, which are cookies necessary for the technical operation of the Site, as they optimise the display of content from each User's device;

. functional cookies, which are not essential to the proper functioning of the Site but which optimise the experience on the Site by enabling Users to be identified and their shopping basket to be retrieved;
Analytics, which enables Users' browsing to be tracked for optimisation purposes. The information collected includes, in particular, the number of visitors, the origin and details of pages visited. This information helps us improve the Site, the shopping experience and DoC's campaigns. DoC uses Google Analytics, a web analytics provider, which:
- collects the following data: origin of connections (access providers), type and version of browser used, browser language, connection duration, IP address, etc.
- stores cookies on users' devices to carry out audience measurements. The data generated by cookies is transmitted by Google Inc. and hosted on servers located in the United States. Google Inc. will use this data to evaluate the use of the Website, but will not associate Users' IP addresses with any other data held by Google Inc. Google Inc. may also transfer this data to third parties if legally required to do so or if these third parties process this data on its behalf. . direct marketing and targeting cookies and third-party cookies, which enable the sending of commercial messages that may be of interest to Users based on their browsing history. Third-party cookies are those sent by trusted third parties.

    The user must accept the deposit of cookies on their device via the banner provided for this purpose when connecting to the Site.

    DoC does not retain cookies that enable the tracking of a User or the obtaining of IP addresses beyond thirteen (13) months after the first deposit on a User's device.

    Users may delete cookies from their browser at any time and configure it to prevent them from being stored on their device. DoC invites them to consult the help file of their browser software to set the appropriate configuration. Browsing the Site without accepting cookies may be degraded.

    Traffic

    Traffic data is generated when users' devices connect to the Internet and to the Site.

    This data may be used for statistical purposes to analyse Site traffic and improve it by adapting it to Users' needs. Traffic data is never used by DoC by name.
